Terms and Conditions of Sale
The owner of the online store maninails.com and maninails.ee (hereinafter the “Online Store”) is Klydon OÜ (registry code 17032961), located at Ristiku tn 9-31, Paide, Järva County, 72715, Estonia.
Validity of the Sales Contract, Product and Price Information
These Terms and Conditions apply to the purchase of goods from the Online Store.
The prices of products sold in the Online Store are indicated next to the products. A delivery fee will be added to the price. All prices in the Online Store are in euros.
The delivery fee depends on the buyer’s location and the selected delivery method. The delivery fee is displayed to the buyer when placing the order.
Information about the goods is provided directly next to the goods in the Online Store.
Placing an Order
To order goods, the desired products must be added to the shopping cart. To complete the order, the required data fields must be filled in and a suitable delivery method selected. The total payable amount will then be displayed on the screen and can be paid securely using the following payment methods:
- Estonian bank payments: Swedbank, SEB, Luminor, LHV, Coop Pank, Citadele
- Visa / Mastercard
- Apple Pay
- Google Pay
NB! When paying via bank link, be sure to click the button “Return to merchant” on the bank’s page.
Estonian bank payments are mediated by Montonio Finance UAB. Payments are made outside the Online Store in a secure environment – via bank link in the secure environment of the respective bank and by credit card via the Stripe payment platform. The seller does not have access to the customer’s bank or credit card details.
The sales contract enters into force upon receipt of the payable amount in the Online Store’s bank account.
The owner of the Online Store is the controller of personal data and transfers the personal data necessary for processing payments to the authorised processor Montonio Finance UAB.
If the ordered goods cannot be delivered due to the goods being out of stock or for any other reason, the buyer will be notified as soon as possible and the paid amount (including delivery costs) will be refunded without delay, but no later than within 14 days from sending the notification.
Delivery
Goods are shipped worldwide.
The buyer may choose between the following delivery options: courier delivery to the address or delivery to an Omniva parcel locker.
The delivery costs are borne by the buyer and the relevant price information is displayed next to the delivery method.
Domestic shipments within Estonia generally arrive at the destination specified by the buyer within 5 working days from the entry into force of the sales contract. Delivery outside Estonia takes place within 25 calendar days.
In exceptional cases, the delivery period may be extended up to 45 calendar days.
Right of Withdrawal
After receiving the order, the buyer has the right to withdraw from the contract concluded in the Online Store within 14 days.
The right of withdrawal does not apply if the buyer is a legal entity.
In order to exercise the 14-day right of withdrawal, the ordered goods may not be used in any other way than necessary to ascertain the nature, characteristics, and functioning of the goods, as would be permitted when testing goods in a physical store.
If the goods have been used for purposes other than necessary to ascertain their nature, characteristics, and functioning, or if there are signs of use or wear, the Online Store has the right to reduce the refundable amount in proportion to the decrease in value of the goods.
To return the goods, a withdrawal statement must be submitted to info@maninails.ee
The cost of returning the goods is borne by the buyer, except where the reason for return is that the returned product does not correspond to the order (e.g. incorrect or defective product).
The buyer must return the goods within 14 days following the submission of the withdrawal statement or provide proof that the goods have been handed over to the carrier within that period.
Upon receipt of the returned goods, the Online Store shall refund to the buyer without delay, but no later than within 14 days from receipt of the withdrawal statement, all payments received from the buyer under the contract.
The Online Store may refuse to issue a refund until it has received the goods back or until the buyer has provided proof that the goods have been returned, whichever occurs first.
If the buyer has expressly chosen a delivery method other than the cheapest standard delivery method offered by the Online Store, the Online Store is not required to refund the cost exceeding the cost of the standard delivery method.
The Online Store has the right to withdraw from the sales transaction and demand the return of the goods from the buyer if the price of the goods in the Online Store has been mistakenly marked significantly below the market price of the goods.
Right to Submit a Complaint
The Online Store is liable for any non-conformity or defect of the goods sold to the buyer that existed at the time of delivery and becomes apparent within two years from the delivery of the goods to the buyer. During the first year from delivery, it is presumed that the defect existed at the time of delivery. The burden of proof to rebut this presumption lies with the Online Store.
In the event of a defect, the buyer has the right to contact the Online Store no later than within two months by sending an email to info@maninails.ee
The Online Store is not liable for defects that have arisen after the goods have been delivered to the buyer.
If the goods purchased from the Online Store have defects for which the Online Store is responsible, the Online Store will repair or replace the defective goods. If repair or replacement is not possible, the Online Store will refund to the buyer all fees associated with the sales contract.
The Online Store shall respond to the consumer’s complaint in writing or in a format that can be reproduced in writing within 15 days.
Direct Marketing and Processing of Personal Data
The Online Store uses the personal data entered by the buyer only for processing the order and delivering the goods to the buyer. The Online Store transfers personal data to companies providing transport services for the purpose of delivering the goods.
The Online Store sends newsletters and offers to the buyer’s email address only if the buyer has expressed such a wish by entering their email address on the website and indicating their desire to receive direct marketing notifications.
The buyer may unsubscribe from offers and newsletters sent by email at any time by notifying us via email or by following the instructions provided in the email containing the offers.
Dispute Resolution
If the buyer has any complaints regarding the Online Store, they should be sent by email to info@maninails.ee
If the buyer and the Online Store are unable to resolve the dispute by mutual agreement, the buyer may turn to the Consumer Disputes Committee. The procedural rules and the submission of a complaint are available there. The Consumer Disputes Committee is competent to resolve disputes arising from contracts concluded between the buyer and the Online Store. The review of the buyer’s complaint by the committee is free of charge.
The buyer may also turn to the European Union’s online dispute resolution (ODR) platform.
